Rules and agreements

These visitor terms and conditions, as established by Het Noordbrabants Museum ('museum'), apply within the museum. The full text of these terms can be viewed on the museum’s website and is available for inspection at the museum’s ticket desk. By purchasing an admission ticket to the museum, the visitor agrees to these terms and conditions and confirms that they have reviewed a copy of the visitor terms and have taken proper note of their content.

1. GENERAL PROVISIONS

1.1. 'The museum' and 'Het Noordbrabants Museum' mean the organisation that manages and operates the museum complex, including, but not limited to, the management board, curators, security officers, and other museum staff who are authorised to act on behalf of this organisation.

1.2. 'The museum complex' refers to all spaces (constructed and unconstructed) under the legal or managerial authority of the management board of Het Noordbrabants Museum, including, but not limited to, exhibition halls, public spaces and meeting rooms, restaurants, coffee rooms, terraces, gardens, other outdoor areas, depots, and annexes.

1.3. 'Visitor' is understood to mean anyone who enters the museum complex in any manner and/or visits an exhibition and/or attends an activity, whether or not organised by Het Noordbrabants Museum.

1.4. These general visitor terms and conditions apply to every agreement between Het Noordbrabants Museum and a visitor and/or any person who enters the museum complex in any way. These terms also apply to special activities outside regular opening hours and/or aimed at individuals other than regular visitors, such as room rental, catering, and similar services.

1.5. These terms apply to all visitors of Het Noordbrabants Museum and the museum complex.

1.6. Deviations from these terms and conditions are only valid if expressly agreed in writing by Het Noordbrabants Museum and the visitor.

2. ACCESS TO THE MUSEUM

2.1. All price quotations, announcements, or other information provided by Het Noordbrabants Museum are non-binding. The museum accepts liability only for errors that are clearly attributable to the museum itself, unless it is obvious that the information was incorrect. This liability applies only to the museum's official informational materials available on-site at the time of the claim or that were recently distributed by or on behalf of the museum. The museum is not liable for errors caused by third-party intent, fault, or negligence.

2.2. Visitors must, upon request, present their admission ticket to clearly identifiable museum staff, including security officers and other personnel.

2.3. The potential visitor is not entitled to a refund of the admission fee or any other compensation in the event of loss or theft of the admission ticket before entering the museum complex. If a potential visitor does not use a pre-purchased admission ticket, this is entirely at their own risk and expense. A ticket valid for a specific time and/or date may be exchanged via the online ticket shop for a different time or date, subject to availability. Refunds are only issued if a valid reason is provided, at the sole discretion of the museum. These terms also apply to tickets purchased via the museum’s online ticket shop.

2.4. Access to the museum complex may be denied if it is determined that the admission ticket, discount card, or voucher was not obtained through Het Noordbrabants Museum or an authorized third party.

2.5. Het Noordbrabants Museum reserves the right to adjust its published opening hours, including for emergency drills or necessary full or partial evacuations of the museum complex. Opening hours are set entirely at the museum’s discretion. Changes in opening hours do not entitle visitors to a refund.

2.6. The museum determines and publishes its opening hours on its website.

2.7. Discount promotions and/or promotional prices cannot be combined. A maximum of one discount or promotional price may be applied per museum product or ticket.

2.8. Access to the museum complexes of Het Noordbrabants Museum and Design Museum Den Bosch is only permitted with a valid online ticket for a specific time slot.

2.9. In the event of a pandemic (such as COVID-19), additional regulations will apply to museum visits. Visitors are required to comply with current measures, which are clearly communicated at the entrance, on the website, and/or on the ticket. Examples of such measures include:

  • Visitors exhibiting symptoms such as a runny nose, cough, fever, or shortness of breath may not enter. Entry is only permitted if the visitor and any household members are symptom-free for at least 24 hours.
  • Wearing a face mask during the visit may be mandatory.

3. WHEN AT THE MUSEUM COMPLEX

3.1. During their visit to the museum complex, visitors must behave in accordance with public order, public morality, and the rules of decency applicable to the nature of the activity visited. Visitors must also immediately comply with instructions and directions given by recognisable officials of Het Noordbrabants Museum, including but not limited to security staff. If, in the reasonable opinion of an authorised official of Het Noordbrabants Museum, the visitor acts in violation of these standards, instructions or directions, access to the museum complex may be denied without the visitor being entitled to any refund of the admission fee or other incurred costs.

3.2. Parents or guardians of minors are at all times responsible for the conduct of the children accompanying them. Children under 12 may only enter the museum complex when accompanied by an adult.

3.3. Het Noordbrabants Museum is not accessible to skaters, riders of skateboards, scooters, hoverboards, or other similar vehicles.

3.4. In the interest of safety, Het Noordbrabants Museum may conduct security checks on visitors and their belongings. Visitors may be asked to cooperate in the inspection of bags or other items by a recognisable museum official, including security staff. Refusal to cooperate may result in denial of access to the museum complex. Visitors must be identifiable. Any visitor whose face is not visible and who refuses to show it during the check will be denied access. If deemed necessary, specially trained staff may request cooperation for a body search upon entry or exit.

3.5. While in the museum complex, visitors must: a. Not offer goods for sale or distribute them for free. Guided tours by visitors are explicitly prohibited. b. Not deliberately block paths or obstruct the view of exhibits for prolonged periods. c. Not disturb other visitors, including by using mobile phones or other sources of noise; exceptions may be made by Het Noordbrabants Museum in designated areas. d. Not bring pets or animals. Recognisable guide dogs and official assistance dogs accompanying a visitor with an ID pass are allowed. e. Not smoke anywhere within the museum complex, except in designated outdoor areas. f. Not consume self-brought food or beverages inside the museum complex or gardens, except on the forecourt or if explicitly permitted by the museum. g. Not carry or consume food and drinks in exhibition areas. Food and drinks bought at the museum may only be consumed in designated areas marked accordingly. h. Not bring any objects deemed dangerous by the museum, or any items larger than A4 size, including skates, skateboards, hoverboards, Nordic walking sticks, non-medical walking sticks, selfie sticks, balloons, backpack baby carriers, backpacks, and umbrellas. These must be stored in the cloakroom. Walking sticks with rubber tips may be taken inside. The museum is not responsible or liable for damage or loss of stored belongings. Prohibited items will be confiscated. Items under legal prohibition will be handed to the police. i. Not touch any exhibits or exhibition materials such as display cases, lighting, or partitions, unless explicitly permitted. Adults must ensure children do not touch exhibits. Small children must be held by the hand or be in a stroller. Teachers and group leaders must ensure group members do not touch the exhibits. j. Not draw or paint without prior permission. The museum may explicitly allow this in certain areas.

3.6. The museum is under camera surveillance. Footage is retained in accordance with data protection laws and may be provided to law enforcement if necessary and legally permitted.

3.7. In emergencies (e.g. theft, terrorist threat, or violence), the museum is authorised to close its doors and evacuate visitors. Visitors may be subject to inspection by recognisable museum officials or security staff.

3.8. Photography and video recording are permitted unless explicitly stated otherwise.

3.9. The museum may take photographs and videos inside the complex for publicity purposes. By entering, visitors give their consent for such materials to be published online, in brochures, or elsewhere. Visitors who object to recognisable use of their image may notify the museum, which will then attempt to prevent publication.

3.10. Visitors who have previously damaged property at Dutch museums or disturbed public order may be denied entry for a set or indefinite period. These visitors may also be subject to the security measures outlined in Article 3.4. Denial of access will be promptly communicated, preferably in writing.

3.11. Het Noordbrabants Museum will make every effort to ensure that visits and activities proceed as advertised, including informing the public about full, partial, or early closures, as well as maintenance or rearrangement activities. No rights to compensation may be derived from this.

COMPLAINTS

4.1. Admission fees will not be refunded in the case of the following unavoidable issues, which do not entitle the visitor to compensation: a. Items from the permanent collection not on display; b. Partial closure of the complex due to exhibition setup or dismantling; c. Disruptions caused by other visitors, including noise, misconduct, theft, or vandalism; d. Disruptions from maintenance, renovation, or rearrangement; e. Malfunctioning of museum facilities.

4.2. Complaints and claims must be submitted in writing within two weeks of the visit. Complaints submitted later will not be processed, and the right to complain expires.

4.3. The museum will investigate and respond to complaints within 15 days. If further time is needed, the visitor will be informed accordingly.

4.4. Visitors may submit complaints and suggestions via a form available at the museum ticket desk or by email.

LIABILITY OF THE MUSEUM

5.1. Het Noordbrabants Museum is not liable for damages caused by incorrect information unless it is due to intent or gross negligence by the museum or its staff, excluding section 2.1.

5.2. Visiting the museum is at the visitor's own risk. The museum is only liable for direct damage or injury caused by its own gross negligence or intent, and only to the extent covered by its insurance.

5.3. Compensation will never exceed: a) the price of the ticket; b) the amount paid by the museum's insurer; or c) the compensation paid by a third party responsible for the damage.

5.4. The museum is not liable for damage to visitors' vehicles.

5.5. The museum is not liable for (in)direct damage resulting from defects in property under its management, unless caused by intent or gross negligence.

5.6. The museum is not liable for damage to goods left by visitors unless caused intentionally or through gross negligence.

5.7. Liability for breach of contract is limited to direct damage, not exceeding the limits of section 5.3.

5.8. In cases of death or injury, compensation does not exceed the amounts in section 5.3.

5.9. The museum is not liable for indirect damages, such as loss of profits or savings.

5.10. The limitations in section 5.3 do not apply if damage is caused intentionally or through gross negligence.

FORCE MAJEURE

6.1. Force majeure includes any unforeseeable event, such as illness, strikes, pandemics, or third-party failures, that makes fulfilling the agreement impossible or burdensome.

6.2. Force majeure also includes events affecting service providers used by the museum.

6.3. The museum may suspend obligations during force majeure. If the situation lasts over two months, either party may terminate the agreement. Force majeure does not entitle the visitor to compensation.

LOST AND FOUND

7.1. Lost items found by visitors can be handed in at the ticket desk.

7.2. The museum will make reasonable efforts to trace the rightful owner. Items not claimed within six months will be disposed of.

7.3. Owners may collect found items in person or request delivery at their expense, subject to proper identification.

OTHER TERMS

8.1. These visitor terms do not override other (contractual) terms and conditions of the museum.

APPLICABLE LAW

9.1. Dutch law applies to these visitor terms and conditions.

9.2. Disputes will be submitted exclusively to the competent court in 's-Hertogenbosch.

These visitor terms and conditions of Het Noordbrabants Museum were adopted by the management team on 10 June 2025.
